Affiliate / Promoter Program Agreement

This Agreement governs your participation in the MEALLDAY affiliate and promoter program (the “Program”). By enrolling or participating, you agree to this Agreement, our Terms of Service, Privacy Policy, and FTC Affiliate Disclosure.
1. Enrollment
You must apply and be approved; we may accept, reject, or terminate any account at our discretion. You must be 18+, provide accurate registration and payment information, and keep your account personal and non-transferable.
2. Brand Use
We grant a limited, non-exclusive, non-transferable, revocable license to use our approved banners, links, images, and trademarks solely to promote MEALLDAY. Do not alter them, imply a partnership beyond promoter status, or register a domain/handle containing “MEALLDAY” or a confusingly similar term. On termination, stop using all brand assets and links.
3. Commissions & Attribution
MEALLDAY pays commission on qualifying sales through your unique link/code at the rate in your dashboard, using the stated attribution (cookie) window and last-click attribution unless stated. Commissions apply to completed, paid orders on the product subtotal, excluding taxes, shipping, discounts, and gift cards. Commissions on cancelled, refunded, charged-back, returned, or fraudulent orders are reversed.
4. Payment & Taxes
Paid on the schedule in your dashboard, subject to a minimum payout threshold. You are an independent contractor responsible for your taxes; provide a valid Form W-9 (US) or W-8 (non-US) before payment. We may hold payment for returns, refunds, chargebacks, or suspected fraud.
5. Mandatory FTC Disclosure
You must clearly and conspicuously disclose your material connection to MEALLDAY in every promotion, per 16 C.F.R. Part 255, close to the recommendation and in plain language. Make only truthful, substantiated claims. Non-compliance is a material breach.
6. Prohibited Methods
No spam (CAN-SPAM/TCPA); no trademark bidding or unauthorized direct linking; no coupon/discount fraud, cookie stuffing, or self-referrals; no false or misleading claims or impersonation; no unlawful, infringing, or objectionable content or content targeting minors; no bots, fake accounts, click fraud, adware, or malware.
7. Term, Liability & Law
Either party may terminate at any time, with or without cause. We may suspend/terminate immediately and forfeit unpaid commissions for violations or fraud. The Program is provided “as is” with no earnings guarantee. You will indemnify MEALLDAY for claims arising from your participation or breach. Our total liability will not exceed the commissions paid to you in the prior six (6) months. Governed by the laws of the State of North Carolina, with disputes in the courts of North Carolina.
